Terminating a pregnancy before forty days

Question: What is the ruling of having an abortion before forty days due to psychological and social circumstances, particularly if she fears divorce from her husband [at any time] in the future?

Response: It is not permissible to terminate the pregnancy out of hatred for it, or to escape from it, this is not permissible. If, however, this was medically called for by the doctors that it is necessary to abort the pregnancy due to the danger it was posing to the life of the mother – and the scholars had issued a fatwa in this regard, then it can be aborted. This is not a matter which should be taken lightly, in that whoever wishes to terminate a pregnancy can do so, no! It is necessary to have a medical report from the specialist doctors, and [then] a fatwa [from a qualified scholar] based upon this report.
