Heading for Makkah, but not intending to do hajj or ‘umrah

Reference: Sharh ‘Umdatil-Fiqh – Tape No.7, Question No.25

Question: What is the ruling regarding the one who heads out to Makkah, but does not intend to do hajj or ‘umrah, so is he required to assume the state of ihraam?

Response: No; the hadeeth [states]:

«And these [meeqaats] are for the people at those very places, and besides them for those who come through those places with the intention of performing Hajj and ‘Umrah» – transmitted by al-Bukhaaree and Muslim.

And this indicates that the one who does not intend to do hajj or ‘umrah is not required to assume the state of ihraam.
